§ 1 Scope of Application
These General Terms and Conditions apply to the use of the platform “Glimm” (hereinafter “Service”), operated by Eliana dos Santos Pereira (Inh.), Wilhelm-Greil-Straße 14, 6020 Innsbruck, Österreich (hereinafter “Provider”). By registering, you accept these Terms of Service.
§ 2 Description of Services
Glimm is a visual documentation tool that offers clients a protected digital space for capturing and visualising personal memories (“light points” / “Glimms”). Therapists may view their clients' light points exclusively during a “session mode” that is initiated by a session request from the therapist and expressly confirmed by the client. Session mode lasts a maximum of 90 minutes and ends automatically. Outside of session mode, therapists have no access to light point content. The Service does not replace therapy and does not constitute a medical or therapeutic offering.
Glimm does not perform any content analysis, automated evaluation, or crisis detection of user-submitted content. In particular, there is no keyword detection, sentiment analysis, or any other algorithmic assessment. The assessment of a client's mental state, the identification of crisis situations, and the initiation of appropriate measures (e.g. crisis intervention, referral to emergency services) are the sole responsibility of the supervising professional in accordance with their professional duty of care.
§ 3 Registration & Account
Registration is intended exclusively for licensed psychotherapists, medical psychotherapists, and comparable professional groups. You are responsible for keeping your login credentials confidential. The Provider reserves the right to suspend accounts that violate this provision.
§ 4 Plans & Payment
All plans (Solo, Practice, Clinic) are paid and billed monthly via the payment service provider Stripe. The prices shown are gross prices including VAT. For customers within the EU, the applicable VAT rate of the destination country is charged (OSS procedure). The final prices including VAT are displayed before completing the purchase. Current prices can be found on the pricing page at glimm.app.
§ 5 Cancellation & Contract Term
The subscription renews automatically for an additional month unless cancelled before the end of the current billing period. Cancellation may be carried out at any time via the account settings or the Stripe customer portal and takes effect at the end of the current billing period. After cancellation, access will be deactivated. A complete account deletion can be requested via the settings or by email to hello@glimm.app.
§ 6 Right of Withdrawal
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us (Eliana dos Santos Pereira, Wilhelm-Greil-Straße 14, 6020 Innsbruck, Österreich, email: hello@glimm.app) of your decision to withdraw from this contract by means of a clear statement (e.g. by email). You may use the attached model withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient to send your notice of exercising the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than 14 days from the day on which we receive notice of your withdrawal. For such reimbursement, we shall use the same means of payment that you used for the original transaction; in no event will you be charged any fees as a result of such reimbursement.
If you requested that the services begin during the withdrawal period and subsequently withdraw from the contract, we will reimburse you in full — no pro-rata charge will be made for services already rendered.

§ 7 Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy. All user-generated content is stored encrypted using AES-256. Email addresses are cryptographically pseudonymised. For further information, please refer to our Privacy Policy.
§ 8 Liability
The Provider shall not be liable for damages arising from the use of the Service, unless caused by intent or gross negligence. The Service does not replace professional therapeutic treatment. Liability for slight negligence is excluded — except in the case of breach of material contractual obligations (cardinal obligations) or injury to life, body, or health.
The Provider assumes no responsibility for the detection, assessment, or management of crisis situations (including suicidality, self-harm, or acute mental health emergencies). Glimm is a documentation tool only, with no analytical or diagnostic capabilities. All clinical responsibility — including duty of care, crisis intervention, and referral to emergency services — remains with the registered professional in accordance with applicable professional regulations.
§ 9 Availability
The Provider endeavours to provide the Service with as little interruption as possible but does not guarantee any specific level of availability. Maintenance work and technical disruptions may lead to temporary limitations.
§ 10 Amendments to the Terms of Service
The Provider reserves the right to amend these Terms of Service. Registered users will be informed of material changes by email at least 30 days before they take effect. For material changes, renewed explicit consent will be obtained. If consent is not given, the previous terms shall continue to apply.
§ 11 Applicable Law & Jurisdiction
Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-law rules of international private law. For consumers domiciled in the EU, the mandatory provisions of consumer protection law of their country of residence remain unaffected (Art. 6 Rome I Regulation). For disputes with consumers, the statutory provisions on jurisdiction shall apply. The place of jurisdiction for businesses is Innsbruck. The language of the contract is German.
§ 12 Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 13 Severability Clause
Should any provision of these Terms of Service be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, such valid and enforceable provision shall apply whose effects most closely approximate the economic objective that the contracting parties intended to achieve with the invalid or unenforceable provision.
